Agreement to Terms
By accessing or using Are U OK ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
Description of Service
Are U OK is a daily check-in application that allows users to:
- Record daily check-ins to confirm their wellbeing
- Designate emergency contacts who will be notified if the user doesn't check in for an extended period (48 hours)
- Receive reminders to check in
Important: Are U OK is not an emergency service. If you or someone you know is in immediate danger, please contact emergency services (911 in the US) directly.
User Accounts
To use the App, you must:
- Create an account with a valid email address
- Be at least 13 years of age
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
You are responsible for all activities that occur under your account.
Emergency Contacts
When adding emergency contacts, you agree that:
- You have the consent of the person you are adding as an emergency contact
- The contact information you provide is accurate
- Your emergency contacts will receive email notifications if you don't check in for 48 hours
- Emergency contacts may receive verification emails when added
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Add emergency contacts without their knowledge or consent
- Attempt to interfere with or disrupt the App's operation
- Create multiple accounts for fraudulent purposes
- Use the App to harass, abuse, or harm others
- Attempt to access other users' accounts or data
Service Limitations
Are U OK is provided "as is" and we cannot guarantee uninterrupted service. The App should not be relied upon as your sole means of emergency communication.
We do not guarantee that:
- The App will be available at all times
- Notifications will be delivered without delay
- The App will detect or prevent emergencies
- Emergency contacts will respond to notifications
Disclaimers
No Medical or Emergency Service: Are U OK is not a medical device, emergency response service, or substitute for professional care. The App does not monitor your health, location, or physical condition.
No Guarantee of Safety: Using the App does not guarantee your safety or the safety of others. We are not responsible for any harm that may occur regardless of whether you use the App.
User Responsibility: You are solely responsible for your own safety and wellbeing. The App is a communication tool, not a safety guarantee.
Limitation of Liability
To the maximum extent permitted by law, Are U OK and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Personal injury or death
- Loss of data or privacy breaches
- Failure to deliver notifications
- Actions or inactions of emergency contacts
- Any damages arising from your use or inability to use the App
Indemnification
You agree to indemnify and hold harmless Are U OK, its operators, and affiliates from any claims, damages, losses, or expenses arising from your use of the App or violation of these terms.
Modifications to Service
We reserve the right to:
- Modify or discontinue the App at any time
- Change these terms with notice to users
- Suspend or terminate accounts that violate these terms
Account Termination
You may delete your account at any time through the App settings. Upon deletion:
- Your personal data will be removed within 30 days
- Your emergency contacts will be notified of their removal
- Any pending escalation alerts will be cancelled
We may terminate your account if you violate these terms or for any other reason at our discretion.
Intellectual Property
The App, including its design, features, and content, is owned by Are U OK and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without permission.
Governing Law
These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
